1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and CrackTheLoop AI ("Company", "we", "us", or "our"), concerning your access to and use of the CrackTheLoop software and website. By accessing or using our services, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE, YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Ethical & Legal Use Responsibilities

YOU ARE RESPONSIBLE FOR USING THE SERVICES ONLY FOR LEGAL AND ETHICAL PURPOSES. You are solely responsible for ensuring that your use of the Services complies with all applicable laws, regulations, and third-party rules that apply to you.

• Recording Laws: You may not use the Services to transcribe, monitor, or process any conversation, interview, or meeting without first obtaining all necessary disclosures and consents required by applicable wiretapping and "two-party consent" laws.
• Academic & Professional Integrity: You may not use the Services to cheat, deceive, or gain an unauthorized advantage in any active professional evaluation, certification process, or academic examination where external AI aids are prohibited.
• Prohibited Actions: You agree not to use the Services to violate the rules, code of conduct, or terms of service of any employer, school, interviewer, or communications platform (e.g., Zoom, Teams, Discord).

We provide the Services exclusively as a general-purpose study and practice utility. We do not condone any unlawful or unethical use, and any such use is a material breach of these Terms.

3. Purchases & Pay-As-You-Go Billing

CrackTheLoop operates on a transparent, pay-as-you-go billing model. We currently charge $1.59 per hour of active transcription and processing time, billed by the minute.

• You agree to provide current, complete, and accurate purchase and account information for all transactions made via the Services.
• You only pay for what you use. Time is deducted from your prepaid balance only when the transcription engine is actively capturing and processing audio.
• Refund Policy: All purchases of transcription credits are final and non-refundable once the transcription time has been utilized. If you experience technical issues or accidental charges, please contact our support team at support@cracktheloop.com within 14 days of the transaction for a discretionary review.

4. Intellectual Property Rights

We are the owner or licensee of all intellectual property rights in our Services, including the source code, visual design, stealth overlay mechanics, and underlying software. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use the software solely for your personal, non-commercial use. You may not reverse engineer, decompile, or otherwise attempt to extract the source code or circumvent the application's security measures.

5. Disclaimer & Limitations of Liability

The Services, including all AI-generated answers, suggestions, and transcriptions, are provided on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the AI outputs. You agree that your use of the Services is at your sole risk.

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or damages arising from failed interviews or evaluations resulting from your use of the Services.
